Pourtex GmbH is a limited liability company, based in Uster (Switzerland). Pourtex GmbH has developed a software respectively point-of-sale (POS) system for dry cleaners, laundries, and tailors. The POS system is called “lagutta.”
These Terms and Conditions (hereinafter referred to as: T&C) govern the use of lagutta. By activating their user account, users (hereinafter referred to as: Customers) accept these T&C.
Hereinafter, the term “lagutta” is used for the POS system. The term “Provider” is used for Pourtex GmbH.

The services and functionalities of Lagutta are described on the website lagutta.com.
During the contract period, the Customer has access to lagutta. The right of use is non-transferable, non-exclusive as well as non-sublicensable.
The contract is formed upon activation of the user account.
The contract lasts for the usage period chosen at the time of user account activation.
The use of lagutta is free of charge for the first 30 days after activating the user account (so-called trial period). Day one of the free trial period is the day of the user account activation, regardless of the time of activation.
The trial period is one-time only. This means the trial period applies to the use of lagutta, regardless of the chosen subscription plan.
After the expiration of the free trial period, the use of lagutta is subject to a fee. Fees are due at the beginning of the usage period. Any deviations from this are subject to a separate individual agreement between the respective customer and the provider.
Prices are listed on the website. Prices are exclusive of VAT. For customers based in Switzerland, the applicable currency is Swiss Francs. In all other cases, EUR is the applicable currency.
The provider has the right to adjust the scope of services and/or the fees for lagutta. The customer will be informed in advance of any significant changes. If the customer does not agree with the adjustment, the customer has the right to terminate the contract at the next possible termination date.
The contract may be terminated at any time. Termination must be made in writing via registered mail or electronically through the user’s profile by deactivating automatic renewal.
Termination takes effect at the end of the usage period. The Customer may continue to use lagutta until the end of the usage period.
Payments are non-refundable, and no refunds or credits will be issued for partially used usage periods.
Customer support is available to the customer during our business hours.
The installation of essential software updates, without which the use of lagutta is not possible, will be communicated to the customer. The customer is then required to install the necessary software updates.
We strive to provide high-quality service and ensure the uninterrupted availability of lagutta. However, we do not guarantee uninterrupted or error-free operation or availability of lagutta.
In particular, we are not liable for damages caused by force majeure or disruptions due to lack of internet connection, illegal attacks by third parties, network overload, or other interruptions by third parties.
We are also not liable for damages incurred by the customer through the use of lagutta, except in cases of gross negligence or willful misconduct.

Should individual provisions of these Terms and Conditions be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected.
The Provider may amend these Terms and Conditions. Customers will be informed of significant changes at least one month before they take effect. If the Customer does not agree with the changes, they may terminate the contract at the end of the usage period.
For all disputes related to the use of lagutta, Swiss law applies exclusively, excluding the provisions of international private law (IPR) and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is the registered office of Pourtex GmbH.
These Terms and Conditions are available in both German and English. In the event of discrepancies between the two versions, the version in German language shall prevail.
